A small business owner fighting copyright infringement

Over the past six years that KENZA International Beauty has been in business, my content, as well as photographs, have been violated by various companies in Europe, Africa and now the United States.

In legal term it is called copyright infringement: https://en.m.wikipedia.org/wiki/Copyright_infringement

Usually, it is from new start-ups or very small businesses that either were not aware of this rule or simply tried and hoped not to be caught. As easy as it is to download a picture or copy content online it is pretty simple to find your work online on other sites. After being kindly notified they apologize and remove the picture or content from their website. But sometimes you have to apply other ways and let’s just say that I was responsible for several websites to be shut down.

The common rule is that when you find a picture on a public domain such as Google and you decide to use it, you have the obligation to first check to whom it belongs, ask for authorization to use it from the owner, or use it and give credit.

You also have tons of photographs ready to be purchased from Shutterstock, Adobe Stock, and many others for a couple of dollars that can be used legally.

This time one of my Argan tree pictures was simply stolen by Nick Chavez Beverly Hills. Without any authorization or credit for my copyrighted work, or shame Nick Chavez Beverly Hills just photoshopped his Thirst Quencher Hydrating Hairspray with Argan oil product on my picture to use it for marketing, commercial and promotion purposes for several months until I confronted them.

After a public pressure via social media (nowadays that’s the best way to get attention and that’s when Facebook become an efficient way to communicate with corporations), they removed it from all their social media platforms (Instagram, Facebook, Twitter, and Pinterest) where they were shamelessly advertising their product: Thirst Quencher Hydrating Hairspray with Argan oil. They also placed it in a newsletter campaign that was sent via an internet service company called Milled.

This was on Milled.com until it will be removed by Google as I requested it by law.

Instead of apologizing for their illegal action they arrogantly challenged me to prove that I was the owner of this particular picture. Well, that picture was taken almost two years ago on a rainy day in the garden of Atlas Kasbah hotel in Agadir, Morocco. For this particular photo shoot, I took a long flight from New York to Casablanca (8 hours), a bus trip to Agadir with my Assistant (7 hours), a car rental and a hotel stay to be able to take this unique photo.

They naively stated that when they found my picture on Google (which by the way was posted on my Blog: What is Argan Oil? where it is clearly mentioned at the bottom: All content is copyright @KENZA International Beauty – Khadija Fajry) they were not familiar with my company so they just decided to take it without permission. Well of course, how easy! I bet they wouldn’t have touched it if they saw L’Oréal instead. {ps: it would be great if Google added a protection for all the non-licensed pictures not to be downloaded easily.}

As many of you know by now just by following my blog, being a client or just a fan on social media, part of my work is to travel on location (Morocco, France) to share with you my discoveries, new ingredients, and share as much information as I can that relate to the production of the botanical ingredients used in my KENZA be generously beautiful™ line.

I spend a big part of my budget on these work travels (time, transportation, accommodations, food, guides, etc) and getting the highest ingredients available too because it is important for me not only to show you the source of everything I use in my KENZA beauty line but also let you discover with me.

Every picture you will see on my blog, website, Instagram, Facebook, Twitter, Google, Pinterest and YouTube, are my own.
All of these photographs are copyrighted as soon as you are the one taking them but if you want to add a layer of protection itis better to register them at https://www.copyright.gov

I am happy to collaborate, share and give information when you simply ask but I will not tolerate that you have the shameless audacity to steal my work.

This statement is for my clients and followers to know what happens behind the scenes. I thank you all for your support during this case and for the past six years. This is also for other small business owners that have to deal with this copyright infringement situation. You are not alone. We have laws that protect us and our work. Don’t let it go unsolved.

It is also for Nick Chavez Beverly Hills clients worldwide (on his website, QVC, Dermastore, Amazon, and all the other marketplaces that he sells on) to see how unethical, arrogant and shameless this company is to steal from a small business like mine instead of just spending a couple of dollars to purchase a picture. What does that tell you about the way Nick Chavez Beverly Hills conducts his business?

I am a minority woman small business owner and I will do all I can to protect and defend my work.

Why do I bring my Argan oil with me when I travel and especially to Morocco where it is widely available?

We all know by now that Argan oil or Moroccan oil is only sourced in Morocco. It is an oil that is produced from Argan nuts that grow only in the southern part of Morocco.

When you travel to Morocco you can see it everywhere and with its increased popularity this last decade worldwide, everybody got into producing and selling Argan oil in Morocco. Unfortunately not all products on the market are regulated which makes it difficult for you buyers to differentiate between good Argan oi, chemically processed and even fake ones.

How can you be sure you are buying pure, authentic, unadulterated, and unrefined Moroccan Argan oil?

That was my main mission when I decided to launch KENZA International Beauty. Those were my worries. How can I be sure to provide only the highest quality, 100% Pure and organic Moroccan Argan oil?

What is Prickly Pear Seed Oil?

WHAT IS PRICKLY PEAR SEED OIL (Barbary Fig Oil, Cactus Oil, Aknari or Opuntia Ficus Indica)?
 
The Opuntia Ficus Indica plant is a member of the cactus family and is commonly known as Prickly Pear (also known as India Fig Opuntia or Barbary Fig). Native to Mexico, it can now be found in various arid and semi-arid areas of the world such as Morocco. Also called the miracle plant for its ability to survive during long droughts and still produce healthy fruits, the cactus plant grows in open fields without exposure to fertilizers or pesticides.
 
 
The Prickly Pear fruit contains numerous small black seeds from which the precious Prickly Pear Seed Oil is extracted. The oil has been used by generations of Berber women to fend off the effects of dry desert conditions.

 
  
Prickly Pear Seed Oil is one of the most expensive beauty oils in the world. Its production requires a labor intensive and time consuming (up to four days) process manually handled by Moroccan women at cooperatives. The Prickly Pear seeds are separated from the pulp and are then dried before being cold pressed. Because each seed contains only 5% of oil, up to 60 lbs. of seeds (and a half a ton of fruits) are required to yield about 34oz. of oil.

How to create your own Hammam SPA?

I love my Saturdays!
Taking time off should be taken without guilt.

Don’t you love the weekend when you get to relax, exercise, spend quality time with your family and friends and most importantly pamper yourself?

After a long week of work managing my business, taking care of my family and figuring out what’s for dinner, I make sure to take some time off and Saturday is my day. I am neither a mom, nor a wife, I am Khadija and I make myself a priority. It may sound selfish but I truly believe that you can always give the best of yourself when you take time to decompress, change your mind and step out of your routine.

What I love is taking fitness classes or working out on my own at Equinox Fitness Club. After working out I love to treat myself, depending on how much time I have, with either a reflexology massage a manicure & pedicure or with a Moroccan Hammam SPA (my ultimate favorite).

Of course I bring all I need: Moroccan Black Soap, kissa (exfoliating glove), a hair mask, a facial scrub (that I also use as a mask because it has rose powder, honey and Argan oil. Soon available in our e-store), and my Argan oil, Fusion oil and Eye serum. Oh, I forgot I soak my hair the night before with my Hair oil Treatment too.

I have to admit that it is nice to have a facility like Equinox where I can do all of this but you can create your own Hammam SPA at home as well. Here is how:

MOROCCAN HAMMAM SPA RITUAL

• In a Moroccan Hammam SPA or your bathroom warm up your body with a hot bath, shower or steam for 10 min to open pores.

• Set up your ambience with essential oils, a diffuser and candles. kenza-aromatology-1

• Apply generously (1 tablespoon) KENZA Pure Moroccan Black Soap all over your body. Let it penetrate for 5 to 10 min (it is important to stay in a warm environment). Rinse off with warm water (no soap). Video via Organic SPA Magazine

• Soak you KENZA Hammam Glove in hot water to soften it before use.

• Rinse the glove and start massaging gently skin (body only) in circular motion. After few minutes layers of dead skin and impurities will roll off the body onto the “Kissa” exfoliating glove.(Wash and dry your KENZA Hammam Glove).

• Soak hair with KENZA Pure Hair Treatment Oil, wrap with a towel or plastic cover. Leave 30min (or the night before).

• In a glass bowl mix a cup of KENZA Pure Rhassoul Lava Clay with 1/2 cup of KENZA Pure Rose Toner , few drops of KENZA Pure Lavender Oil and add warm water or milk until you get the right consistency of a paste to apply all over your body and face. Lie down, let it dry for 15-20min. Rinse the clay off.

• Wash with your favorite KENZA Soap (SPA Bar Soap or Moroccan Oils Soap) and shampoo hair.

• Indulge in a rich, fragrant and sensual KENZA Pure Marrakech Body Oil and apply your favorite KENZA Facial oil (Argan oil, Prickly Pear Seed Oil, or Fusion oil).

Moroccan Rose Water
